1. Introduction

At Eternal Forge Entertainment Company and/or its affiliates (“Eternal Forge Entertainment,” “we,” or “us”), we are committed to protecting your privacy and complying with all applicable laws related to personal information. This Privacy Policy describes how we collect, use, share, and protect the personal information we obtain from you during and after your relationship with us.

This Privacy Policy applies to all our Properties, which include:

• Eternal Forge Entertainment websites, online products, and services.
• Eternal Forge Entertainment console and PC games.
• Eternal Forge Entertainment mobile games and applications.

Please note that this Policy does not apply to third-party websites or online properties that may be linked from our Properties. Eternal Forge Entertainment is not responsible for the privacy or security practices of such third-party sites.

In some cases, we may redirect you to a site operated by a partner or provider. Even if the page where you provide your information appears to be part of our Properties, another privacy policy may apply regarding the collection of information from that partner or provider.

Translations of the Terms

If Eternal Forge Entertainment has provided you with a translation of the English language version of these Terms, you agree that the translation is provided solely for your convenience and that the English language versions of these Terms will govern your relationship with Eternal Forge Entertainment. If there is any contradiction between what you read in the English language version of these Terms and the translation, the English version will prevail and govern.

2. The information we collect

As described in more detail below, Eternal Forge Entertainment may collect information about you when: a. You create an Eternal Forge Entertainment account with one of our Properties. b. You use our Properties. c. You participate in sweepstakes, contests, and promotions sponsored by us. d. You communicate with our customer service. e. You opt to receive our newsletters, marketing emails, or participate in our surveys. f. You receive mobile advertising. g. You make purchases of Eternal Forge Entertainment products or services online. h. You share your information through our social networks.

a. Creating an Eternal Forge Entertainment account

When registering on one of our Properties, we will collect certain information, such as your email address, username, and in some cases, phone number. This personal information may be combined with other data, such as your date of birth, country, interests, use of different products and services, and advertising preferences.

We also collect and combine information when you link a third-party account (for example, Xbox Live, PlayStation™Network, Steam, Epic Games, Android, or iOS) to your Eternal Forge Entertainment account. This may include the username and email associated with that third-party account.

b. Use of our Properties

When visiting or using our Properties, we collect, process, and combine information about your use of these. This may include websites visited before and after, browser type, language, IP address, hardware and software data, advertising ID, linked third-party account information, game data, communications, data usage, purchase history, and social network information.

For this purpose, we may use cookies or other similar technologies. Both we and our advertising partners may use cookies and advertising identifiers to show you relevant ads on our Properties. Please see our Cookie Policy for more details.

We also collect data such as age, gender, interests, email, gaming and marketing preferences, customer service information, and data related to your devices.

Certain information about you, including third-party account data and game information, may be displayed publicly on our Properties or on properties operated by our partners and licensees. For example, your username on other platforms may appear on leaderboards if you are among the top players in certain Eternal Forge Entertainment games.

If you have linked a third-party account to your Eternal Forge Entertainment account, we or our third-party partners and licensees may make your username searchable by other users, unless you have opted out of this feature. You can unlink third-party accounts or prevent your information from being searchable at any time through your Eternal Forge Entertainment profile settings.

To ensure fair gameplay, we use anti-cheat technologies in our games. We may monitor and/or record your gameplay and communications (including chats and voice communications) as specified in the applicable Terms of Use or End User License Agreement.

c. Sweepstakes, contests, and promotions

When participating in sweepstakes, contests, or promotions organized by Eternal Forge Entertainment on our Properties, we will collect certain data from participants, such as name, address, postal code, email, phone number, age and/or date of birth, or other information or content submitted.

We may need to collect additional information for you to claim a prize. This information may be combined with other data from your account and will be used and shared in accordance with this Privacy Policy.

d. Customer service interactions

To provide customer support and help you resolve any issues you may have, we collect information including your contact details, problem details, information shared with our customer service, and its resolution.

e. Subscription to newsletters, marketing, or surveys

We offer you the possibility of periodically receiving via email, in-app notifications, or SMS (in eligible countries) newsletters and/or marketing about our products and services that may interest you.

We may also occasionally send you surveys to improve the gaming experience with our products. You can manage your preferences at any time through your account settings and unsubscribe from our newsletters using the link included at the end of all our emails, declining app notifications, or following the instructions in the SMS. If you reside in the U.S., you will be subject to the SMS terms of use.

f. Mobile advertising

Our mobile games may include advertising for third-party products and services. By accepting this Privacy Policy and downloading or continuing to play our mobile games, and unless you opt out of interest-based advertising as explained in our Cookie Policy, you agree that we and our advertising partners may collect, share, and use information about you to show you relevant third-party ads in our games and to improve advertising, profiling, and measurement systems.

When you use our mobile games, we collect and share information, including advertising identifiers, non-personal identifiers, and other information from your mobile device with advertising partners to technically enable the delivery of ads to your device. Our advertising partners may combine this information with other information they have collected about you when using their services (or third-party websites or services) to provide you with more relevant ads in our mobile games or to improve the accuracy of their profiling and measurement systems.

We recommend that you review the privacy policies of our advertising partners, which can be accessed from our Cookie Policy, for more information.

You can review your options to manage and opt out of mobile advertising by (1) visiting the website of your mobile device manufacturer or consulting your device manual (most mobile device manufacturers will inform you about how you can manage your mobile device settings to disable or remove cookies from it, to limit the use of your advertising ID, reset it, or disable the use of targeted advertising); or (2) visiting http://youronlinechoices.com, or if you are in the European Union, http://www.youronlinechoices.eu/, for information about opt-out options for advertising. You can also click on the AdChoices logo within an ad (if available).

Please note that adjusting your preferences as described in this section does not mean that you will no longer receive ads; it only means that the ads you see will be less relevant to your interests. Additionally, we will continue to use your device’s advertising ID to serve ads that may be less relevant to you; for example, we may limit the frequency (controlling the maximum number of times we show you the same ad).

g. Purchase of Eternal Forge Entertainment products or services online

Eternal Forge Entertainment does not collect credit card and/or billing information when you purchase products or services (such as digital content) online. You may need to provide your credit card or billing information to one of our external providers to complete a purchase.

We recommend that you review the privacy policy of these external providers, as their data protection practices may differ from ours. In certain cases, you may also provide information to Eternal Forge Entertainment (such as your email address) at the time of purchase to receive additional information or offers.

h. Social networks

You may interact with some of our Properties through social networking sites such as Facebook, Instagram, or Twitter, among others (or their plugins and applications). When interacting with Eternal Forge Entertainment or our Properties through social networks, you agree that we may access certain information about you, such as your name, username, or profile picture, according to the privacy settings of your social networks, and use it to personalize content and marketing, improve and adapt the user experience in relation to Eternal Forge Entertainment Properties, as well as (1) provide you with exclusive content; (2) personalize your online experience with us within and outside our Properties; and (3) contact you according to your marketing preferences, either through social networking sites or directly, to inform you about news, special offers, and rewards.

Regarding any personal information, including that which you post through our Properties or on social networks, it may be viewed publicly by other users of these sites, and we cannot prevent third parties from using that information. i. Information provided by other sources

We obtain information, such as contact data (for example, name and email address), country, IP address, purchase history, marketing preferences, cookie information, hardware and software data, and other technical information from other sources through partners, providers, and other third parties.

The parties from which we obtain information are typically corporate companies (although some may also be educational or public companies) and may be located in any of the places where we do business. These companies primarily fall into the following categories: advertising and marketing companies, data set and information providers, public database providers, social networking platforms, partners, product or service providers, hosts or vendors at events or trade shows, or research partners.

We take measures to confirm that the information we receive from these third parties has been collected with your consent or that these third parties are legally authorized to disclose your personal information to us. We may also obtain information through a partner, or jointly create data sets with a partner, as part of our business operations. This type of data is used for work such as improving algorithms and data models, testing and product improvements, and the development of new capabilities and features.

In some cases, we combine personal information about individuals that we receive from multiple sources, including directly from you or through your use of Eternal Forge Entertainment services or Properties.

j. Legal basis for our use (for EEA visitors only)

If you are in the European Economic Area, our legal basis for collecting and using the personal information described above will depend on the personal information in question and the specific context in which we collect it.

However, we will collect personal information from you only when we have your consent to do so, when we need the personal information to enter into a contract with you, when we have a legal obligation to do so, or when the processing is in our legitimate interest (such as processing for administrative purposes, direct marketing, product development or improvement, prevention of fraud or criminal acts, and in support of information security) and is not overridden by your data protection interests or fundamental rights and freedoms.

If we ask you to provide personal information to comply with a legal requirement or to enter into a contract with you, we will make this clear at the time of collection. We will also inform you if the requirement for that information is mandatory and explain the consequences if you do not provide the information.

Similarly, if we collect and use your personal information based on our legitimate interests (or those of any third party), we will take reasonable steps to provide clear notice and describe our legitimate interests.

3. How we share information

As detailed below, Eternal Forge Entertainment shares information:

• With Eternal Forge Entertainment group companies, including for marketing purposes of the group companies.
• With providers, partners, and licensees contracted by Eternal Forge Entertainment to provide you with the goods or services you have requested or the online advertising selected by us, or to create applications and websites that benefit our player community.
• If required by applicable law, regulation, or ongoing legal process.
• If necessary to exercise, establish, or defend our legal rights.
• If necessary to protect the rights, property, or safety of any person.
• In connection with the sale of our business or assets.

Please note that any information, including personal information, that you disclose in a message board, chat room, or other public forum may be viewed publicly, and you are solely responsible for the disclosure of such information.

a. Eternal Forge Entertainment group companies

We share your information with Eternal Forge Entertainment group companies, including for marketing purposes of the group companies. Eternal Forge Entertainment is not responsible for the privacy practices of Eternal Forge Entertainment group companies, and the use of your information by the group companies will be governed by the specific privacy policies of each company, which you can find on each company’s website.

b. Providers, partners, and licensees

Providers and partners provide goods and services (for example, platform providers, media partners, event ticket providers, merchandise providers, tournament providers, survey providers, billing, customer support, consulting, information technology hardware and software) to Eternal Forge Entertainment to support, operate, and develop the Properties and to send marketing communications on our behalf. Occasionally, providers use your information to execute, deliver, or improve the services they provide.

Eternal Forge Entertainment does not share information with providers for them to use directly for commercial purposes or any other purpose not established in this section without your consent. We also share certain information about our players (for example, game information) with our partners and licensees who create applications and websites that benefit our player community (for example, tournaments, leaderboards, and game statistics tools).

c. Legal compliance

Eternal Forge Entertainment may disclose your information in good faith when required by law, including, but not limited to, disclosure to law enforcement or other government agents, in connection with an investigation of fraud, intellectual property rights infringement, or other illegal activity, or that may expose you or Eternal Forge Entertainment to legal liability. This may include responding to legal requests from jurisdictions outside the United States when we believe in good faith that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

d. Exercise of legal rights

We will disclose your information when necessary for the purpose of exercising, establishing, or defending our legal rights. For example, we may review your game information, communications, and other account data to investigate allegations of cheating, hacking, or any other breach or alleged breach of our applicable Terms of Use to this Privacy Policy, as well as disclose your personal information, including communications, to our legal advisors and consultants, as well as to law enforcement and other government agents.

e. Protection of third parties

We will disclose your information to third parties when we deem it necessary to protect the rights, property, or safety of any person. For example, we may disclose information related to an online account if we believe in good faith that the user is using it in a harmful way to others (such as establishing inappropriate contact with minors).

f. Sale of our business or assets

Additionally, in the event of a merger, acquisition, restructuring, bankruptcy, or similar event, the information of Eternal Forge Entertainment customers, including your information and communications, may be transferred to a successor entity or assignee.

4. INFORMATION COLLECTED BY THIRD PARTIES

Our Site and Games use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on your device, to help the website analyze how users use our Services. The information generated by the cookie about your use of the Services or device (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will also use this information for the purpose of evaluating your use of our Services, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage.

Google may also transfer this information to third parties when required by law, or when such third parties process the information on behalf of Google. Google will not associate your IP address with any other data held by Google.

From time to time, we and third parties may provide software application downloads available for your use on or through the Services. These applications may separately access, and allow a third party to view, your identifiable information, such as your name, your user ID, your computer’s IP address or other information like the game you are playing during any session, and any cookie that you may have previously installed or that may be installed for you by a software application or website of a third party. Additionally, these applications may ask you to provide additional information directly to third parties. Third-party products or services provided through these applications are not owned or controlled by Eternal Forge Entertainment. We encourage you to read the terms and other policies published by such third parties on their websites or in other locations.

5. DISCLAIMER REGARDING SECURITY AND THIRD-PARTY SITES

WE DO NOT GUARANTEE THE SECURITY OF PERSONAL INFORMATION OR OTHER INFORMATION THAT YOU PROVIDE ON THIRD-PARTY WEBSITES.

We implement various security measures to maintain the safety of your personal information that is in our possession or under our control. Your personal information is behind secure networks and is only accessible to a limited number of persons who have special access rights to such systems and are required to keep the information confidential. When you place an order or access your personal information, we offer the use of a secure server. All personal or confidential information you provide is encrypted in our databases so that only the persons mentioned above can access it.

In an effort to provide you with greater value, we may choose various third-party websites to link to, and frame within the Site or Games. We may also participate in co-branding and other relationships to offer e-commerce and other services and features to our visitors. These linked sites have separate and independent privacy policies as well as their own security arrangements. Even if the third party is affiliated with us, we have no control over these linked sites, each of which has separate privacy and information collection practices independent of us. Data collected by our co-brand partners or third-party websites (even if offered on or through our Site and Games) may not be received by us.

Therefore, we have no responsibility or liability for the content, security arrangements (or lack thereof), and activities of these linked sites. These linked sites are only for your convenience and, therefore, you access them at your own risk. Nonetheless, we seek to protect the integrity of our Site and Games and the links placed on them, and therefore welcome any feedback about these linked sites (including, among other things, if a specific link does not work).

6. Protection of minors

Eternal Forge Entertainment does not intentionally collect or store personal information from children under 13 years of age in the United States or below the applicable legal age in any other jurisdiction where the child is located. However, we will collect from all users of our Properties the technical information necessary to provide the service and support our internal operations. If parents suspect that we have inadvertently collected other personal information about their children or have used it for other purposes, they can contact us through the “Contact Us” service below.

We are aware of the special obligation to protect personal information obtained from minors. We urge parents to instruct their children never to provide their real names, addresses, or phone numbers without parental permission when they are online. Eternal Forge Entertainment recommends that parents and guardians familiarize themselves with parental controls available on consoles, mobile phones, tablets, and other devices that children may use, as well as supervise their children when they are online. 7. Security

Eternal Forge Entertainment takes a number of security measures designed to help protect your information, as detailed below. However, it is impossible to guarantee complete security, both online and offline, so you should be careful when sharing your information online.

Eternal Forge Entertainment takes a number of security measures designed to protect your personal information and maintain its confidentiality (unless it is not of a confidential nature, such as public domain information, user-generated content, ratings, scores, etc.). We also take the reasonable steps necessary to protect the information we collect from misuse and alteration. Additionally, we require providers that process personal information on our behalf to take security measures to protect your personal information. However, by its very nature, the Internet is not a secure environment, and the nature of security threats evolves constantly, as do the technical and organizational standards of the industry to handle such threats. Therefore, Eternal Forge Entertainment cannot guarantee the absolute security of any personal information collected, stored, or used by us or our providers.

8. Your privacy options

Withdrawing your consent

You can withdraw your consent for the collection, use, or disclosure of your personal information in our possession or under our control by sending an email to our Data Protection Officer at contact@eternal-forge.com.

However, withdrawing your consent could mean that we cannot continue to provide you with the Services, and we may need to terminate the existing relationship or contract you have with us.

Requesting access or correction of Personal Information

• a. If you have an account with us, you can personally access or correct your personal information currently in our possession or control through the account settings page or tab on the Site or in the Games. If you do not have an account with us, you can request to access or correct your personal information currently in our possession or control by sending us a written request. We will need enough information from you to determine your identity, as well as the nature of your request, to be able to process your request. Therefore, please send your written request by email to our Data Protection Officer at contact@eternal-forge.com.

b. We may charge you a reasonable fee for handling and processing your requests to access your personal information. If we decide to do so, we will provide you with a written estimate of the fee we will charge. Please note that we are not required to respond to or fulfill your access request unless you have agreed to pay the fee.

c. We reserve the right to refuse to correct your personal information in accordance with the provisions established in the Privacy Laws, which require or allow an organization to refuse to correct personal information in established circumstances.

d. We will delete personal information that we process for contract performance or based on your consent in the event that you terminate your contract with us, if you deactivate your Eternal Forge Entertainment account, withdraw your consent, or request that we delete your personal information in accordance with this Privacy Policy. As an exception, we will not delete your personal information when we continue to have a legitimate interest in the use of such information. For example, we may retain your information to resolve disputes, enforce our Terms of Use or other user agreements, or comply with legal requirements; in this case, the use of your personal information will be restricted for any other purpose. In any case, we will not retain or use your personal information for longer than necessary for the purposes established in this Privacy Policy. For technical reasons, residual copies of the information deleted from your account and/or the Properties may remain stored in our backup systems for approximately one month.
